Why ‘Working Safely’ Training Matters
In the case of R v Porter [2008], a nursery manager was prosecuted after a child tragically died from choking. The prosecution argued he had failed to carry out proper risk assessments or provide adequate staff training in emergency procedures—a breach of health and safety law.
The nursery manager was convicted by a Jury and whilst his conviction was overturned on appeal, the Judges said whilst management must be proven to have failed in a way that significantly endangered health or safety, they had a legal duty to provide training to ensure safe working.
This case highlights that employers and managers can be held criminally liable if they fail to provide essential health and safety training and put people at risk.
